Contract (appendix) I. Party A shandong Institute of Commerce & Technology wishes to engage the service of Party B---------------------- (---------------------translated name in Chinese) from ---------------as Foreign teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it. II. The period of service will be from the 31st day of August , 2006 to the 31st day of July 2007 . III. The duties of Party b 1. According to Party A’s requirement and arrangement, Party B shall complete 18 teaching periods (45-miniutes per period) per week in a professional manner, including speaking, listening, writing and reading. 2. Party B shall observe Party A’s work system and regulations concerning teaching administration. Party B shall make up the missed lessons on time; avoid absence and teaching longer than required. 3.Party B shall observe the direction and arrangement of the Dean’s Office and Foreign languages Department in Party A concerning teaching affairs. 4.Party B shall receive the supervision and evaluation from relevant departments in Party A. Party B shall see to it that over 70% of the students in Party A is satisfied with Party B’s work. 5.Party B shall attend teaching research seminars conducted by Foreign Languages Department regularly. 6.Party B shall be under the administration of Foreign Affairs Office in Party A. Party B shall inform the Foreign Affairs Office when going out ,o receiving friends including on holidays and off days, asking for leave and changing the teaching schedule. IV. Wages and benefits 1. Direct Pay Party B’s monthly salary will depends on the classes that Party B actually takes. Party A will pay Party B 70 Yuan RMB for every class. Salary will be paid from the registration date to the expiration date of the contract. Party B will be paid on the fifteenth day of every following month. The salary for winter holiday is 3000 Yuan RMB (If the winter holiday is more or less than 30 days, the salary for winter holiday is 3000 Yuan RMB). According to Party A’ teaching plan, if there is no class for Party B to teach in July, Party A will not pay Party B salary. Party B shall pay for its income tax according to the Chinese taxation laws. 2. Indirect Benefits 1) Party A shall provide Party B with apartment furnished with furniture, beddings, telephone, TV set, fridge, bathroom, heating and air conditioning, kitchen and simple kitchen appliances. Other household appliances will be paid by Party B. 2) Party B shall pay for the gas, electricity and water fees. 3) Party A shall provide Party B a computer; Party B shall pay the Internet fee. Party B should be responsible for the damage of the computer that caused by Party B’s improper use. 4) The telephone will be paid by Party B. 5) Party A will pay Party B travel allowance 2,200 Yuan per year. 6) Party A shall pay Party B medicine allowance 2000 Yuan RMB per year. 7) Party A shall provide Party B with double-round international plane tickets once a year (economy class from the nearest airport in Party B’ s country to China). Party B should provide copies of the air tickets. If Party B does not go home, Party B cannot enjoy the air ticket welfare. Party A will pay Party B 3000 Yuan for Traffic allowance. 8) Party A shall provide Party B with 24 kg excess luggage transportation cost by plane back home on condition that Party B leaves after the contract expires. V. Work Hours and Vacations 1. Party B shall complete about 18 45-minutes periods’ English teaching per week. 2. Party A shall pay higher salary if it asks Party B to work overtime. 3. Party B shall have the following Chinese vacation: New Year’s day, the Spring Festival (about 3 weeks), May Day Vacation (about one week，paid), Chinese National Day (Oct 1st)(about one week, paid), and other vacations stipulated by the Chinese laws, decrees and relevant regulations. 4. Party B shall have a 2-day Christmas holiday. 5. Sick leave and private affair leave 1) Party A shall Pay Party B 100% salary if Party B can display Doctor’s certification from the nominated hospital and the accumulative total sick leave within the contract period is less than 20 days. If the accumulative total sick leave within the contract period is more than 20 days, Party A has the right to cancel the contract. If Party A does not cancel the contract, Party A shall deduct 150 Yuan RMB for one more sick leave day from Party B’s salary 2) Party B shall ask Party A’s consent for private leave. Within the contract period, the accumulative total private affair leave shall not exceed 10 days and the continuous private affair leave shall not exceed 3 days, otherwise, Party A shall deduct 150 Yuan RMB for one more private affair leave day from Party B’s salary If Party B is absent without leave for one day, Party A shall deduct 500 Yuan RMB from Party B’s salary .If Party B is absent without leave for too long, Party A has the right to cancel the contract and ask Party B to pay a breach penalty. VI. Probation Period 1. Party B’s probation period is 60 days. In this period, if Party A finds out that Party B’s health condition or knowledge cannot be competent for its work stipulated in the contract, Party A has the right to cancel the contract. 2. Party A shall reimburse Party B’s single one-way ticket cost to China and pay for it before the contract expires if Party A promises to do so in the contract. VII. The confirmation and modification of the terms of this appendix shall be consulted by the two parties and shall be stipulated in a written form. Any oral promise is invalid. The two parties shall consult with each other and mediate and disputes which may arise about the contract. Any party who breaks the contract will pay 10000 Yuan RMB for fine. The appendix is an inseparable part of the contract and has equal effect. The faxed contract has equal effect as the contract.
